former Westchester real estate attorney, Brian Schmidt, 49, of Warwick, has been arrested and charged with grand larceny for allegedly stealing over $50,000 from a client's sale proceeds in 2022. According to the felony complaint, Schmidt represented the home seller at a closing and unlawfully retained her funds.
Schmidt surrendered to law enforcement, pleaded not guilty, and was released on his own recognizance pending further court proceedings. If convicted, he faces up to 15 years in state prison. In June 2024, Schmidt was disbarred from practicing law due to this incident and other alleged misconduct.
Westchester District Attorney Susan Cacace stated, "As representatives of the public, attorneys have a significant responsibility that they must uphold. Brian Schmidt is accused of betraying that trust for personal gain."
