NAR Clarifies Clear Cooperation Policy with Key Update

New CCP feature enables "delayed marketing," keeping listings off IDX feeds and search sites.

he National Association of Realtors has decided to keep its Clear Cooperation Policy in place, but is introducing a new flexibility for sellers who want to delay listing homes via multiple listing services. The policy, called Multiple Listing Options for Sellers, allows sellers to temporarily hold off on marketing their home through the Internet Data Exchange (IDX) feed.

    This "delayed marketing exempt listings" category will enable sellers to keep their listings out of the IDX feed for a limited time, giving them more control over how and when they market their property. However, this option is not available without the seller's written consent, which must be obtained by the listing agent before using this new category.

    MLSs will have the flexibility to decide what timing works best for their areas, but listings within this new category will still be visible to other MLS participants via the MLS platform. This change comes in response to studies that found off-MLS listings can cost sellers thousands of dollars per home, with communities of color disproportionately harmed by the practice.

    NAR President Kevin Sears said the policy changes allow for greater choice for sellers while considering buyers' need to access information through MLSs. The new policy is effective immediately and must be implemented by September 30, giving MLSs six months to decide on their local marketing delays and make necessary technical adjustments.
