Dallas court has temporarily halted plans by development firm Henry S. Miller to upzone a 15-acre shopping center in Far North Dallas, known as Pepper Square. District Judge Martin Hoffman issued an injunction last Friday, preventing the City Council from voting on rezoning proposals for the site at 15030 Preston Road. The decision comes after the Save Pepper Square Neighborhood Association sued the firm, claiming it failed to follow proper sign-posting procedures.

    The lawsuit alleges that Henry S. Miller, led by CEO Greg Miller, did not comply with the city's notification sign ordinance. The firm plans to continue pursuing its project, which includes redeveloping the shopping center into nearly 1,000 apartments, retail space, and restaurants. Despite this, opponents of the plan remain concerned about increased traffic congestion and reduced property values.

    Former Dallas City Council member Lee Kleinman expressed disappointment with the court's decision, arguing that neighbors had received ample notice over two years through community meetings and mailed notifications. He claimed that zoning signs were posted multiple times on the property. The opposition group, however, welcomed the judge's ruling as a victory for following city rules.

    The temporary injunction will likely delay further action on the rezoning proposal for several weeks while the city awaits compliance with notice requirements.
