uffolk Construction is suing Behring for $20 million over construction delays at a 452-unit luxury apartment complex in Oakland. The Massachusetts-based general contractor claims the Danville-based developer breached their contract, causing significant costs and delays on the 39-story high-rise at 1900 Broadway. Suffolk alleges that Behring pushed back the project's start date multiple times, from November 2019 to May 2020, resulting in rising costs and unpaid bills for pre-development and management expenses.
The lawsuit also accuses Behring of failing to pay for change order requests, causing delays related to permanent power and utility issues, and not providing timely design documents. Suffolk claims it has been forced to fund construction due to Behring's excessive project budget. The development is one of several new apartment buildings in Oakland, which has flooded the market with available units.
Behring completed construction in March but announced plans to open the doors to tenants in April. However, according to the lawsuit filed in August, construction was still ongoing and achieved substantial completion in June 2024. This dispute comes after a similar issue between Suffolk and the Trump Group over delays at an under-construction project in Florida last year.
