Aby Rosen Seeks Reprieve from Default via Goldman Family's Hotel Debt Hurdles

Aby Rosen uses emperor's new clothes to deflect attention from his own financial woes and legal troubles.

A
by Rosen is attempting to deflect attention from his financial troubles by pointing out the internal power struggle within the Goldman family, which owns Solil Management. As RFR Realty's CEO faces numerous lawsuits and foreclosures across the country, Rosen claims that the legitimacy of actions taken against him by Solil are in question due to the family dispute. This argument could potentially delay any action taken against RFR tenants until the dispute is resolved.

Rosen's efforts may be seen as creative, according to real estate attorney Joshua Stein. The issue stems from a 2021 lawsuit filed by Solil against RFR for failing to pay nearly $1 million in rent during the pandemic. After RFR was evicted in 2022, Solil signed a new lease with MCR Hotels for $50 million.

Rosen is now requesting a stay on damages proceedings, citing that the court's previous ruling in favor of Solil may be "in serious question" due to allegations made in the Goldman family dispute. He claims that Jane Goldman, who led Solil during the eviction process, may not have had authority to act on behalf of the company. If other Goldman family members take control, they may choose not to pursue litigation against RFR or even challenge Jane's original actions.

Rosen's argument could potentially impact the new lease signed by MCR Hotels, which may be altered or rescinded if other Goldman family members are involved. This desperate attempt by Rosen comes as he faces a barrage of lawsuits and foreclosures, including a recent foreclosure action on $22 million in loans for commercial condos in Manhattan.
