Arizona Real Estate Authority Sues Developer Over Alleged Misconduct

he Arizona Department of Real Estate has issued a cease and desist order to Morning Vista Homes, a housing developer, citing concerns over the lack of a guaranteed water supply for their projects in Rio Verde Foothills. According to Gov. Katie Hobbs' office, the developer failed to obtain necessary "subdivision public support" that would secure a "certificate of assured water supply." This move is seen as an attempt by the developer to evade consumer protection and water security laws.

    Gov. Hobbs expressed her satisfaction with the swift action taken by the Arizona Department of Real Estate, stating that Rio Verde Foothills has suffered enough due to developers building without securing a water supply. She emphasized the need for legislative action to address loopholes exploited by developers to profit at the expense of everyday Arizonans.

    The cease and desist order prohibits Morning Vista Homes from selling or advertising parcels in specific subdivisions until a 100-year water supply is secured. This comes after Rio Verde Foothills faced a water access crisis due to issues with the city of Scottsdale, which was resolved through a standpipe agreement in fall 2023.

    The Arizona Department of Real Estate Commissioner Susan Nicolson stated that education of developers is key, but when subdivision Public Report requirements are not followed, buyers are exposed to unacceptable risks.
