federal judge has dismissed a lawsuit alleging Tal and Alon Alexander raped a woman while their brother Oren watched, ruling that the complaint was time-barred. Judge Lewis Kaplan argued that Angelica Parker missed the window to file her lawsuit over the alleged 2012 attack, citing New York State's Adult Survivors Act as the applicable law. The state law opened a one-year window for survivors of sexual violence to sue their alleged perpetrators, which closed in November.

    Parker's complaint was filed under an extension of New York City's Victims of Gender-Motivated Violence Protection Law, which allowed claims related to any gender-based violence and had a two-year window that closes in March. However, Kaplan ruled that the city's statute was pre-empted by the state law.

    Tal's attorneys claimed that Parker's lawsuit was "frivolous" and part of an "opportunistic" trend of people coming forward with new claims after reading about other lawsuits. But Evan Torgan, representing other plaintiffs in civil lawsuits against the brothers, pushed back, saying the judge's ruling ignores the 42-plus women who have reported sexual assaults to the FBI.

    Parker's attorney, Michael Willemin, disagreed with the court's decision and expects it to be reversed. The ruling could impact other lawsuits filed against the Alexanders if judges side with Kaplan. Torgan noted that the New York Court of Appeals will ultimately decide how the statute deadlines are interpreted.

    Tal is facing three lawsuits over sexual assault, including one complaint filed in Miami this week alleging he sexually assaulted a woman with his brother Oren's assistance in 2021. The Alexanders have denied all allegations and are being held at the Metropolitan Detention Center in Brooklyn awaiting trial. If convicted, they face up to life in prison.
