orthwest MLS is pushing to dismiss Compass' lawsuit, arguing that the brokerage can't claim a right to an exemption from its rules while still demanding access to others' listings. In a June 30 filing, the MLS says Compass' allegations are "an effort to entrench a free-riding, exclusionary strategy" that undermines competition and harms consumers.

    Compass had filed suit in April after Northwest MLS suspended its IDX feed for two days in response to the brokerage's private exclusives blitz in defiance of the MLS's rules. The MLS argues that Compass is a longtime member that agreed to follow its rules and can't claim a legal right to an exemption.

    The motion also seeks to dismiss claims related to Washington state law, saying Compass failed to identify specific contracts or business relationships that Northwest MLS allegedly interfered with. The MLS acted within its rights and rules at all times, the filing states.

    Compass argues that Northwest MLS rules prohibiting pre-marketing and office exclusives limit seller choice, hurt consumers, and block the brokerage from employing its marketing strategy in the region. A trial date has been set for next June, but the judge will consider the motion to dismiss on July 28.
