efendants in the Missouri lawsuit are pushing back, seeking dismissals from the case. Several big brokerages have already settled in the buyer agent commission lawsuits, but litigation continues in U.S. District courtrooms. In Missouri and elsewhere, a flurry of filings were submitted on October 11.
Multiple motions to dismiss were filed by remaining Gibson defendants in the Western District of Missouri. The defendants include several major real estate companies that argue they should be dismissed due to a "flawed" interpretation of the Clayton Act or lack of jurisdiction. For example, Chicago-based Baird & Warner claims it doesn't engage in operations within the district and therefore shouldn't be subject to personal jurisdiction.
In related lawsuits, some plaintiffs have objected to settlements reached in the Gibson case, arguing that the monetary damages are too small and could interfere with other ongoing litigation. In a separate development, Wasatch Front Regional Multiple Listing Service (Utah MLS) was dismissed from the Homie Technology lawsuit without prejudice, allowing the plaintiffs to potentially sue them again in the future.
eXp Realty has filed documents with the court, officially submitting its $34 million settlement and requesting that proceedings be paused in the Gibson case. The brokerage expects a preliminary motion for approval of the settlement to be filed within 45 days.
