e're planning to sell our home this summer, but we have a concern about a neighbor's son who was recently arrested for felony statutory rape. The 18-year-old boyfriend was caught with his 14-year-old girlfriend in the home and later released after the father declined to press charges. He still lives in our neighborhood.
As a homeowner, we're wondering if we need to disclose this information to potential buyers. Fortunately, Arizona law doesn't require us to reveal details about sex offenders living nearby. According to A.R.S. § 32-2156, homeowners don't have to disclose sex offenders "located in the vicinity" of the home.
This means we won't be required to inform buyers about the arrest when selling our home.
