n Oct. 3, Judge Stephen R. Bough of the U.S. District Court for the Western District of Missouri granted preliminary approval for five new settlements in the Gibson antitrust case. The agreements involve Hanna Holdings, William Raveis Real Estate, EXIT Realty, Windermere Real Estate, and William L. Lyon & Associates (now operating under Windermere). The court deemed the deals fair, reasonable, and adequate, and ordered the parties to arrange a final‑approval hearing.
If finalized, the defendants will contribute $39.7 million to the existing $1 billion‑plus settlement fund: Hanna Holdings $32 million, William Raveis $4.1 million, EXIT $1.5 million, and Windermere & Lyon $2.1 million. These payments will help resolve commission‑related antitrust claims from home sellers nationwide.
Remaining defendants in Gibson include eXp, Weichert, and Berkshire Hathaway Energy. eXp and Weichert already reached settlements in the separate Hooper case; those agreements received preliminary approval in May and await final approval on Oct. 28, where Gibson plaintiffs may file additional objections. Berkshire Hathaway Energy has yet to propose a settlement.
Seventeen other Gibson defendants have already received final approvals. In Oct. 2024, settlements with Compass, Real Brokerage, Realty One, @properties, Douglas Elliman, Redfin, Engel & Volkers, HomeSmart, and United Real Estate totaled over $110 million. In June, final approvals for NextHome, The Keyes Company, Illustrated Properties, John L. Scott Real Estate Affiliates, John L. Scott/The K Company Realty d/b/a LoKation, Real Estate One, and Baird & Warner Real Estate added $8.35 million in damages.
