key defendant in W. Preston Moore's antitrust lawsuit has been dismissed without prejudice by Judge J. Nicholas Ranjan. The Pennsylvania Real Estate Commission was dropped from the suit, but Moore is given the opportunity to amend his complaint and address "pleading deficiencies" by April 25.
In dismissing the commission, Ranjan cited a lack of specific allegations against it in the original complaint. Moore's lawsuit, filed in November 2024, accuses several real estate associations and officials of conspiring through NAR's three-way membership agreement and violating civil rights statutes.
Moore is also required to serve the remaining defendants within the next 30 days or risk having his claims dismissed without prejudice. Pennsylvania Attorney General David W. Sunday had previously filed a motion to dismiss on behalf of the state's real estate commission, citing similar concerns about the complaint's allegations.
Moore's lawsuit is one of five antitrust suits filed against NAR with similar allegations.
