webinar hosted by the Association of Real Estate License Law Officials (ARELLO) and Zillow featured leaders from various real estate organizations, who expressed concerns that repealing the National Association of Realtor's Clear Cooperation Policy could have far-reaching consequences for agents, consumers, and the housing market. The panelists argued that private listing networks would primarily benefit large brokerages at the expense of smaller ones, leading to a consolidation of power in the industry.
Without the CCP, big brokerages would likely dominate private listings, shutting out smaller firms and independent agents who lack access to these exclusive networks. This could lead to an uneven playing field, where buyers feel pressured to work with larger brokerages to gain access to listings. Art Carter, CEO of the California Regional Multiple Listing Service, predicted an "explosion" of private listings if the CCP is repealed.
The shift towards private listings would also obscure market data, making it harder for consumers and agents to understand what's happening in their local markets. This lack of transparency could lead to a decrease in accessibility and availability of housing information, which is essential for a fair and democratic housing market.
Furthermore, repealing the CCP could result in more fair housing lawsuits against individual agents and brokerages. Janet Thoren, ARELLO's 2025 president, believes that the industry will see an increase in potential fair housing issues, while Laurie Benner, associate VP of housing and community development for the National Fair Housing Alliance, sees it as a "huge step backward" for marginalized buyers.
Some panelists questioned whether private listing networks are truly about respecting client privacy or if they're primarily a recruiting tool to attract clients and agents. A Zillow survey found that many agents recommend private listing networks to sellers without fully explaining their implications, leading to concerns that sellers may not be getting adequate disclosures.
