he Eighth Circuit Court of Appeals has upheld a lower court's decision, dismissing claims that real estate agents infringed on the copyrights of a home designer. The court ruled that including floor plans in listings of homes designed by the individual constitutes fair use.
In making this determination, the appeals court sided with the lower court's assessment that the inclusion of floor plans did not constitute copyright infringement. This decision allows real estate agents to continue using floor plans in their listings without fear of liability.
