EXIT Realty resolves Gibson commissions dispute

Details of the deal were not disclosed; defendants seek judge removal.

recent court filing revealed that EXIT Realty has reached a settlement in the Gibson case, but the terms remain under wraps for now. The agreement was announced on April 8 by attorneys representing EXIT and the plaintiffs. While the damages amount is not disclosed, it's expected to be made public when the plaintiffs submit their motion for preliminary approval at a later date.

    EXIT Realty boasts over 22,000 U.S. agents across the country, according to the Real Estate Almanac. The brokerage joins several other major players who have already settled in the Gibson case, including Compass, Douglas Elliman, and Redfin, which collectively agreed to pay $110 million in damages last October. More recently, six additional settlements received preliminary approval in February, with William Raveis announcing a deal in March.

    However, some prominent brokerages remain on the sidelines, including eXp, Weichert Realtors, Howard Hanna, and Berkshire Hathaway Energy. Interestingly, both eXp and Weichert have reached agreements in a separate lawsuit in Georgia, prompting accusations of a "reverse auction" strategy from the Gibson plaintiffs. Although these firms are still liable in the Gibson case, their deals in the Hooper case can proceed, albeit with potential objections at approval hearings.

    Meanwhile, recusal motions continue to plague the Gibson case. Crye-Leike has joined Howard Hanna and Berkshire Energy in requesting that Judge Stephen Bough step down from the case, citing concerns over his wife's campaign donations. The plaintiffs have pushed back against this motion, pointing out that Howard Hanna's own lawyers made similar contributions.
