Missouri court allows discovery to proceed in commissions lawsuit despite Georgia settlement approval.

Missouri court has ruled that discovery can continue in a lawsuit against eXp and Weichert, despite preliminary approval of settlements in a related case in Georgia. U.S. District Court Judge Stephen Bough denied the brokerages' motion to pause litigation, citing no hardship for the firms if discovery proceeds. The judge noted that since the Gibson plaintiffs intend to pursue discovery regardless of the outcome in Hooper, it should be allowed to continue.

    The plaintiffs are still investigating whether a reverse auction took place, an allegation they made after eXp announced its settlement in the Hooper case. Bough previously called this behavior "questionable." The judge said objections to the settlements can be presented at the final approval hearing on October 28.
