bill aimed at increasing transparency and protecting homeowners in solicited real estate transactions has cleared the Washington State House of Representatives. Sponsored by Rep. Brandy Donaghy, House Bill 1081 now heads to the Senate for further consideration.

    The legislation requires companies initiating real estate contracts to inform homeowners of their rights, including the right to an appraisal, which they must cover. This is intended to ensure transparency and fairness in transactions initiated through public advertising or direct contact with homeowners who may not fully understand the terms of the offer.

    Under HB 1081, property owners approached by a buyer without listing their home for sale will be entitled to key protections. They have the right to request an appraisal within three business days after signing the contract, and the buyer must cover the cost. Homeowners can cancel the contract without penalty if they receive the appraisal within four business days.

    To ensure transparency, all purchase contracts must clearly state these rights in boldface type, and sellers must acknowledge them before finalizing the sale. If a seller chooses to cancel, they can do so by sending a notice via mail or email, which will be considered valid upon delivery to the buyer's designated place of business.

    Transactions involving licensed real estate agents are exempt from these requirements. Any violations of the bill's provisions will be enforced under the Consumer Protection Act, providing legal recourse for homeowners who are misled or taken advantage of.

    House Bill 1081 passed the House with a 56-39 vote and now moves to the Senate for further debate. If enacted, it would take effect on January 1, 2026.
