NAR Board Approves Language to Clarify Fair Enforcement of Article 10.

he National Association of REALTORS' Board of Directors has reaffirmed its commitment to diversity and equal professional service by approving language changes that clarify how state and local associations can fairly enforce Article 10 of the Code of Ethics.

    Article 10 prohibits REALTORS from denying services or opportunities based on protected characteristics, but the board's action brings greater clarity to Standard of Practice 10-5, which addresses harassment. The new language defines "harassment" in line with NAR's Member Code of Conduct and focuses enforcement on instances where REALTORS are acting as professionals.

    The changes were recommended by the Professional Standards Committee and aim to ensure that the Code of Ethics is clear, fair, and consistent. The committee developed Standard of Practice 10-5 five years ago in response to racial unrest and housing discrimination reports following George Floyd's killing. Although the policies have been subject to challenges, NAR leaders believed updates were necessary to protect Article 10's intent.

    The revised language will be effective immediately, reducing uncertainty for state and local associations and volunteer leaders who enforce Article 10. NAR President Kevin Sears reiterated the association's commitment to fair housing and equal treatment in a letter to stakeholders following board ratification of the changes.
