This has sparked a heated debate about whether private listings should be included in MLS platforms. Industry leaders and real estate professionals are discussing the Clear Cooperation Policy, which requires agents to post their listings on the MLS within one business day of marketing a property for sale. This policy has attracted legal attention and is being considered by the National Association of Realtors' MLS Technology and Emerging Issues Advisory Board for potential changes.
One MLS, Bright, has successfully implemented a policy requiring agents to input all exclusive listings. This policy is not new, according to Rene Galicia, executive vice president of customer advocacy at Bright. However, an upgrade made in January called "Listing Management" has made it easier for listing agents to switch exclusive listings to standard active listings, which happens for most exclusive listings. Galicia believes that pocket listings should remain a rare occurrence.
This issue is not just about data accuracy but also about fairness and equality. By restricting access to property information, Bright aims to prevent discrimination based on factors such as a person's background or social status. By promoting listings on the MLS through a real estate agent, Bright aims to create a fair and competitive housing market where everyone has an equal chance to find a home or sell their property at the best possible price.
The future of Clear Cooperation remains uncertain as NAR considers proposals to reinforce, change, or remove the policy. The policy's fate will depend on what proposal is presented to the NAR board of directors for approval (potentially as early as November) and any legal actions taken by judges or the Department of Justice.
