eichert Realtors, the 11th-largest brokerage company in the US, has agreed to settle a class action lawsuit in Georgia without admitting wrongdoing. The New Jersey-based franchise was originally named in the Gibson case but was not included in the Hooper case. Weichert's settlement is similar to eXp Realty's strategy of settling with plaintiffs outside of the Gibson and Sitzer/Burnett cases.
Weichert, which has over 15,000 agents and generates $45 billion in annual sales, filed a request for a stay in the Gibson/Umpa case on November 6. The company is also a defendant in the Batton 2 case brought by homebuyers and has been seeking dismissal of that case.
The settlement amount was not disclosed, but more details will be made available when the preliminary settlement is filed. This strategy has led to a power struggle between the Gibson and Hooper plaintiffs, with the Gibson plaintiffs filing a motion to intervene in the Hooper case and have it transferred to Missouri. The judge's ruling on this motion could affect the approval process of Weichert's settlement.
