The Federal Chamber of German Architects (BAK) has expressed its explicit support for the submitted draft bill on the so-called Building Type E. By legally establishing an independent contract type based on binding basic standards, a dependable legal framework is to be created for simpler, more economical and resource-efficient planning and delivery across all building types.
Increased legal certainty and relief for housing costs
The initiative for this new regulation originates largely with the chambers of architects. At its core, the approach aims to restore broader scope for design and decision-making to planning professionals. At the same time, unnecessary cost drivers, which have frequently arisen from excessive comfort and specification standards, are to be dismantled.
Andrea Gebhard, President of the Federal Chamber of German Architects, views the project as a major opportunity to tangibly reduce construction costs. The creation of a separate contractual category ensures transparency while strengthening consumer protection. Gebhard emphasised that savings achieved through more practical specifications must directly benefit the public, particularly through affordable residential rents. Municipal housing companies with tight target rents in particular could benefit considerably from this leeway.
Focus on planning quality and life cycle
From the perspective of the Federal Chamber of German Architects, the new regulation offers the prospect of permanently removing disproportionate requirements and establishing Building Type E as a new standard in the construction sector. However, the professional association cautions that the entire life cycle of a building must always be considered. What is executed cheaply during construction must not become a problematic property in the long term.
- —Creation of a legally secure framework with basic standards across all building types
- —Reduction of excessive comfort and specification standards to cut construction costs
- —Focus on long-term economic efficiency throughout the entire building life cycle
- —Maintenance of high living and execution standards through intelligent planning services
In this context, President Gebhard stressed that qualified planning does not represent a cost driver, but forms the fundamental element for lasting sustainability, profitability and living quality. Simpler construction does not mean compromising on quality; instead, it demands more intelligent design. The Federal Chamber of German Architects will examine the draft thoroughly ahead of the deadline on 9 November 2026 and continue to advocate for practical regulations to guarantee binding legal certainty for affordable construction to both designers and clients.
