lawsuit filed in Oregon's U.S. District Court accuses Compass of violating the Telephone Consumer Protection Act (TCPA) by contacting a homeowner multiple times despite their number being listed on the National Do Not Call Registry. The complaint, filed on June 17, alleges that Compass agents contacted Jessica Murch, a resident of Clackamas County, Oregon, in August 2024 and again in June this year, despite her explicit requests to stop.
Murch claims she was contacted by a Realtor with Compass who asked if she wanted to sell her home, even though she wasn't a customer and had never consented to receive calls or messages from the company. After instructing the agent not to call, Murch received multiple text messages offering to list her home and relocate, which she responded to by asking Compass to stop contacting her.
The lawsuit suggests two classes: one national class of people who received more than one marketing call from Compass in a 12-month period over the last four years, despite being listed on the National Do Not Call Registry; and an internal class of individuals who received multiple calls even though they weren't current customers and had asked for the calls to stop. Murch is seeking up to $500 per alleged TCPA violation for both classes, plus up to $1,500 in damages if the calls are found to be willful.
Compass declined to comment on the pending litigation, stating "We don't comment on pending litigation."
