Washington state judge has allowed Compass' antitrust case against Northwest Multiple Listing Service (NWMLS) to proceed with its discovery phase. Judge Jamal Whitehead denied NWMLS's motion to pause discovery, citing concerns that a blanket stay would cause unnecessary delays. While NWMLS may still file a more targeted motion to address specific discovery requests, the judge made it clear that such a motion is not a guarantee of success.

    Compass had alleged in its lawsuit that NWMLS's policies are monopolistic and anticompetitive, limiting seller choice and preventing Compass from implementing its marketing strategy. NWMLS maintains that its rules promote market transparency for all parties involved.

    Separately, Howard Hanna's settlement agreement with home sellers in the Gibson commissions case has moved forward. The two parties have formally executed a settlement agreement, which will be presented to the court for preliminary approval within 60 days. Details of the agreement remain undisclosed, but it is expected to include monetary damages and policy changes regarding commissions.
