                                inCEN has delayed the implementation of its Residential Real Estate Transfers Rule, which mandates reporting of cash or non‑financed residential sales to businesses or trusts, until March 1, 2026. The rule, originally set to take effect on December 1, now gives industry participants an additional 15 months to file required reports. Treasury officials said the extension eases compliance pressures while maintaining safeguards against money laundering, terrorist financing, and other illicit activities. The rule, issued on August 29, 2024, requires real‑estate professionals handling closings and settlements to report such transactions because they bypass banks, which already enforce anti‑money‑laundering regulations. By capturing these cash deals, FinCEN aims to prevent criminals and corrupt actors from moving or concealing illicit funds. The Treasury emphasized that the postponement does not diminish the rule’s objective of protecting the U.S. financial system, but instead provides the industry with sufficient time to comply. The Treasury noted that while the risks of illicit finance linked to non‑financed residential transfers persist, the delay will allow firms to adjust systems, train staff, and align internal controls with the new reporting obligations.
