Phoenix Realtors Push Back Against NAR's MLS Choice Initiative

NAR's MLS Choice lets non-Realtors join Phoenix association; PAR warns of "chilling" effect on innovation.

he Phoenix Association of Realtors (PAR) has responded to a cease-and-desist letter from the National Association of Realtors (NAR), stating that it is willing to discuss the issue but will not withdraw its new MLS Choice offering. In a December 23 letter, PAR's attorney challenged NAR's interpretation of MLS Choice, saying it would "chill innovation" among other associations and multiple listing services (MLSs).

    According to PAR, MLS Choice allows non-Realtors to access MLS services and products at an annual cost of $249 - less than half the price of a three-tier membership. However, those who choose MLS Choice cannot call themselves Realtors and will lose access to association benefits like discounted insurance and a broker legal hotline.

    NAR had sent a December 18 email to its board of directors and leaders, stating that it was taking action to defend its three-way agreement requiring Realtors to join local, state, and national associations. However, NAR emphasized that it was not limiting access to the MLS for non-Realtors, but rather maintaining standards for the Realtor brand.

    PAR's CEO Andy Fegley said in a statement that MLS Choice is a fee-based subscription, not a Realtor membership, and that PAR will continue to support and champion Realtors. He expressed surprise at NAR viewing increased options as a threat and offered to make changes to MLS Choice materials to alleviate confusion.
