A
luxury boutique condominium project in South Beach has been hit with allegations of construction defects by its Ten30 Condominium Association. The Coral Gables-based Shoma Group, led by Masoud and Stephanie Shojaee, is being sued along with general contractor Luke & Sons Construction for issues at the 33-unit building on 15th Street in Miami Beach.
According to a complaint filed in Miami-Dade Circuit Court, extensive defects were found during inspections conducted by engineering firm Indian River Construction Services. These included accumulation of rainwater in emergency exit staircases and the underground parking garage due to a lack of proper drainage systems, as well as numerous cracks throughout the stucco building and excessive humidity in some common areas.
The lawsuit also accuses Shoma Group of misrepresenting the upscale quality of the units to buyers, who paid between $566,000 and $1.9 million for their properties. This is not the first time Shoma has faced allegations of failing to deliver as promised at Ten30, with a previous buyer suing over missing features in his penthouse unit.
Shoma Group's attorney Christopher Utrera stated that they stand by their work product and are committed to addressing the concerns raised by the condo association. However, he acknowledged that such claims are common in South Florida's condominium development environment.
